Sony Tariff Lawsuit Expands Pressure Over PS5 Price Hikes

Sony Interactive Entertainment is facing a proposed nationwide class-action lawsuit in the United States (U.S.) over PS5 price increases tied to the Trump administration’s International Emergency Economic Powers Act (IEEPA) tariff policy. Consumers allege the company benefited both from higher console prices and later tariff refunds issued after the policy was ruled unlawful.

The case, ‘Walker et al v. Sony Interactive Entertainment LLC,’ was filed May 6, 2026, in the U.S. District Court for the Northern District of California.

According to Kotaku’s reporting on the lawsuit, plaintiffs Amorey Walker and Bryce Foster-Quarles argue Sony could receive what the complaint describes as “a double recovery windfall.” They claim the company passed tariff costs onto consumers and later became eligible for refunds after the U.S. Supreme Court ruled the tariffs unlawful.

The lawsuit further alleges Sony retained “a substantial windfall generated by unlawful tariffs imposed by the federal government under the International Emergency Economic Powers Act.”

PS5 Pricing Decisions Become Core Dispute

Sony raised PS5 prices by $50 USD in August 2025 before implementing a larger second increase in April 2026.

According to the complaint, the standard PS5 and Digital Edition each increased by a combined $150 during that period, while the PS5 Pro rose by $200. Plaintiffs claim the increases were introduced to offset tariffs imposed during the IEEPA period. They argue that those tariffs are now subject to federal refunds through a U.S. Customs and Border Protection reimbursement process created after the Supreme Court ruling. 

The proposed class would include all consumers who purchased PlayStation consoles beginning Aug 1, 2025. Court records show Magistrate Judge, Sallie Kim, is overseeing the case, with an initial case management conference scheduled for Aug 3, 2026, in San Francisco.

Nintendo and Amazon Also Face Tariff Refund Claims

Sony is the latest major company targeted over tariff-era pricing. Nintendo was sued in April 2026 by consumers seeking refunds tied to price increases on Switch products following the same tariff ruling. Amazon has also reportedly faced similar claims in 2026.

The lawsuit arrives during the slowing PlayStation hardware sales. Sony reported 1.5M PS5 sales during the quarter ended March 31, 2026, down from 2.8M units a year earlier. The company also recently disclosed that it is increasing internal use of artificial intelligence (AI) technologies following restructuring efforts that included studio closures.
